Process Servers

WHO MUST REGISTER

The registration for process server must be filed with the County Clerk of the county in which he or she resides or where the principal place of business is located if that person makes more than 10 services of process within this state during one (1) calendar year for specific or in expectation of specific compensation which is directly attributable to the service of process.

A corporation or partnership must register as a process server with the county clerk of the county where its principal place of business is located if they derive or expects to derive compensation from service of process within this state.

Exempt from filing are the sheriff, marshal or government employee acting in the scope of his or her employment, an attorney, court appointee, or licensed private investigator or their employees.

A certificate of registration is effective for two years. Thereafter, a registrant shall file a new certificate of registration and pay the fee required.
